By means of this petition, moved under Section 482 of the Code of Criminal Procedure, 1973 (for short Cr.P.C.), the petitioner has sought quashing of the proceedings of Criminal Complaint Case No. 85 of 2000; Smt. Rajlata Sharma Vs. Sanjay Kumar Agarwal, relating to offences punishable under Section 420, 406 of I.P.C., police station Kotwali Haridwar, pending in the court of Judicial Magistrate, Haridwar. 2. Heard learned counsel for the parties and perused the papers on record. 3. This petition under Section 482 of Cr.P.C. was filed by the petitioner on 28.09.2000 before the Allahabad High Court, where stay was granted on 09.10.2000. Subsequently, the petition was received by transfer to this Court under Section 35 of the U.P. Reorganization Act (Central Act No. 29 of 2000), for its disposal. 4. Learned counsel for the petitioner drew attention of this Court to the copy of the criminal complaint (Annexure-I to the petition) and argued that even if the allegations in the criminal complaint are accepted, ingredients of the offence punishable under Section 420, 406 of I.P.C. are not made out.

There is nothing in the complaint which shows that there was entrustment of the money to the petitioner. As such, even if the allegations made in the criminal complaint are taken to be true, the ingredients of the offence punishable either under Section 420 of I.P.C. or under Section 406 of I.P.C., are not made out. What has been mentioned in the criminal complaint constitutes only civil liability. 5.
