JUDGEMENT 1. Heard the parties. 2. The petitioner has come to this Court being aggrieved by the action of the Headmaster of Chandi Prakhand Government School within the district of Nalanda. 3. There are two schools in Chandi Prakhand. One is a boys school and the other is a girls school. The Headmaster of the boys school is taking admission of the girls in the boys school on the ground that there is no prohibition of taking admission of girls in a boys school and there is no rule framed by the State Government prohibiting such admissions. 4. The admissions are again going to commence in May. This matter should be considered by the Principal Secretary, Human Resources Development Department, Vikash Bhawan, Patna and the Director, Secondary Education. The question whether boys and girls can study together or not in Government Schools is a decision that lies squarely with the authorities. The respondent nos. 1 and 2 should take a decision within a period of three weeks from the date of receipt/production of a copy of this order. 5. I may make it clear that I am not giving any opinion with respect to allowing or disallowing co-education in the Government schools. 6. This application is disposed of with the aforesaid directions.
