Raj Mani Chauhan,J.:- Heard learned counsel for the petitioner and learned A.G.A. for the State as well as perused the documents available on record. This petition under Section 407 of Code of Criminal Procedure (hereinafter referred to as Code) has been filed by the petitioner for transfer of Case No. 4363 of 2006 (Case Crime No. 18 of 1995), under Sections 323, 504, 506, 324, 427, 326 I.P.C., Police Station Bewana, District Ambedkar Nagar from the court of Judicial Magistrate-I, Faizabad to the court of Judicial Magistrate, Ambedkar Nagar. The submission of learned counsel for the petitioner is that there was cross case of the criminal case sought to be transferred. Both the cases were pending in district Faizabad before carvation of new district Ambedkar Nagar, but on account of carving out a new District Ambedkar Nagar, the cross case was transferred to Ambedkar Nagar as the occurrence related to P.S. Bewana which is in district Ambedkar Nagar while the present case was not transferred to district Ambedkar Nagar. Therefore, the case referred above also be transferred to District Ambedkar Nagar. Keeping in view the submissions of learned counsel for the petitioner, this petition is being disposed of finally with the observation that the petitioner may raise his grievance for transfer of the case as referred above to district Ambedkar Nagar from district Faizabad on account of carving out a new district as well as the cross case has already been transferred to district Ambedkar Nagar.
