Hon'ble Surendra Singh,J.:- Heard learned counsel for the applicants as well as learned A.G.A. for the State. Taking note of the submission made by learned counsel for the parties and having gone through the record, it appears that the dispute seems to be between the husband and wife and there are fair chances of settlement of the dispute between them, thus the parties should be given a chance to settle their differences on their own terms and conditions through the process of Mediation and Conciliation Centre. Let this order be placed before the Registrar General/Incharge of Allahabad High Court's Mediation and Conciliation Centre, Allahabad. Registrar General/ Incharge Medication and Conciliation Centre will issue notices to both the parties fixing a date for their personal appearance before Mediator nominated by the Organizing Secretary of Mediation and Conciliation Centre. It is directed that applicants shall deposit a sum of Rs. 8,000/- within two weeks from today with the Mediation Centre out of which Rs.6,000/- shall be paid to Smt. Reeta-opposite party no.2 for her appearance before the Mediation Centre and to bear other expenses and the remaining Rs.2,000/- will go to Mediation Centre. In case Smt. Reeta-opposite party no.2 fails to appear before the Mediation Centre on the date fixed despite the services of notices the amount so deposited (Rs.6000/-) for her payment shall be returned to the applicants. It is directed that Mediation Centre shall decide the matter expeditiously preferably within a period of three months from today and find a possible solution of dispute between the parties. Thereafter the case shall be listed before the regular Bench on 29.3.2011. Till the next date of listing, further proceedings against the applicants in Case No.1993 of 2008 (State Vs. Mukesh and others), under Sections 498-A,323 IPC & 3/4 Dowry Prohibition Act, P.S. Kotwali, Shamli, District Muzaffarnagar shall remain in abeyance. After depositing the amount, aforesaid, notice shall be issued to the parties and in the case the aforesaid amount is not deposited within the aforesaid period, the interim protection granted above shall be deemed to be vacated.
