Judgment :- (S.A. BOBDE, J.) Rule returnable forthwith. Heard by consent. 2] The petitioner – Assistant Professor has challenged the order dated 25.1.2010 which in terms does not direct his transfer from the office of Associate Dean, College of Agriculture, Nagpur, to the A.H. & Dairy Akola, but merely directs him “to work physically” at A. H. & Dairy Akola, until further orders. By the said order one Shri Motghare – respondent no.5 Assistant Professor of Veterinary Science borne on the establishment of Associate Dean, College of Agriculture, Nagpur, is likewise not transferred from Nagpur to A.H. & Dairy Akola, but is directed exclusively “to physically work” under the Associate Dean, College of Agriculture, Nagpur. 3] The respondent – Panjabrao Krishi Vidyapeeth seems to have resorted to this peculiar manoeuvre since admittedly there is no post of Assistant Professor (Veterinary Science) at Akola. In fact since there is no post, it is clear that no employee can be transferred to a non-existent post. Peculiarly, the order shows that Shri Motghare who is being transferred from Akola to Nagpur now has always been receiving his pay and allowances from the College at Nagpur. We are informed that even after the impugned order sending petitioner to Akola, his pay and allowances will be continued to be drawn at Nagpur. 4] Having regard to the circumstances of the case, we hold that the petitioner can not be transferred to a non-existent post in Akola and continued to be paid from Nagpur. We however, make it clear that this does not mean that P.K.V. can not direct any of its employee holding the post of Assistant Professor at Nagpur to work at Akola on circuit. It is very clear that P.K.V. is entitled to get the sanctioned posts at Akola or even transfer the existing posts of Assistant Professor (Veterinary Science) from Nagpur to Akola, whereupon a suitable person can be posted to that post. The impugned order is thus quashed and set aside. Rule made absolute in above terms.
