JUDGMENT : C.N. Ramachandran Nair, J. These four writ petitions are filed one after another seeking certain directions from this Court to the State Government to take effective steps to prevent boat tragedies of the kind that happened in Thattekkad, Kumarakom and Thekkady. Petitioners have relied on recommendations of various judicial commissions appointed to enquire into the boat tragedies. Even though Rules were not framed for long, in spite of repeated tragedies and specific recommendations by various judicial commissions, which enquired into such tragedies, the latest tragedy at Thekkady was an eye-opener to the Government. Considering the observations of this Court in various interim orders issued in these batch cases, Government have framed Rules in exercise of powers conferred on the State Government under various provisions of the Inland Vessels Act, 1970. According to the Government Pleader, all precautionary measures were taken by the Government to prevent boat tragedies in future. Since writ petitions were filed before framing of Rules, we close these writ petitions giving freedom to the petitioners to bring to the notice of the Government any inadequacy in the Rule for correction and if not, to approach this Court for necessary relief. In view of the Rule framed by the Government, we do not think any further direction is required to be issued to the Government in this matter. 2. In Writ Petition (C) No. 6090 of 2007, petitioners have sought for various directions to the Government and educational agencies to ensure safety of school children taken on excursions. Even though general directions of the kind sought for need not be issued in the context of these writ petitions, we feel Government should take steps to ensure that students are taught swimming at a fairly young age. Unfortunately, Kerala does not have many swimming pools for access to the public. It is for the Government to provide sufficiently large swimming pools, at least in every district to provide coaching facility to school students coming from that district. In fact, the District Sports Council could probably set up swimming pools at a central location in every district and maintain it giving schedule to students from various schools for learning swimming. Government is directed to take immediate steps in this regard.
