Sunil Gaur, J. (Oral):- 1. This is a petition by the complainant-wife for quashing of FIR No. 95/09 under Section 406/498-A of Indian Penal Code registered s?t Police Station Delhi Cantt., at her instance. It is stated that the Petitioner No. 1 wife and Respondent husband are happily living together since 14th October 2009 as this matrimonial dispute stood resolved through the Mediation Cell of Family Court at Dwarka, vide Annexure P-2. 2. Assistant Sub-Inspector Saroj Bala, Investigating Officer of this case identifies Petitioner No. 1, who is present in person, as the first informant of the FIR in question. Petitioner No. 1 states that she is happily living with Respondent-husband and she prays for quashing of the FIR in question. Respondent ? husband is also present and he has been identified to be an accused of the FIR in question. 3. Petitioner No, 1-wife as well as Respondent husband states that they are happily living together and in order to maintain cordial relations between them, these proceedings ought to be put to an end. 4. In case of "B.S. Joshi v. State of Haryana", AIR 2003 SC 1386 , the Apex Court has declared that in matrimonial offences, it becomes the duty of the court to encourage genuine settlements of matrimonial disputes. 5. Since this matrimonial dispute stands resolved mutually, amicably and voluntarily, no useful purpose would be served in continuing with the proceedings arising out of the FIR in question. Resultantly, FIR No. 95/09 under Section 406/498-A of Indian Penal Code registered at Police Station Delhi Cantt., and proceedings emanating therefrom, stands quashed qua the Respondent ? accused. 6. It is made clear that this order would not stand in the way of the Petitioner No. 1-wife in case she has any matrimonial grievance, in future, against the Respondent ? husband. 7. This petition stands disposed of. A copy of this order be given dasti.
