Hon'ble SHARMA, J.—Heard learned counsel for the complainant-petitioners, learned counsel for the non-petitioners 2 and 3 and the learned Public Prosecutor. 2. This misc. petition has been filed under section 482 Cr.P.C. for quashing the criminal proceeding pending before the court of Judicial Magistrate No. 2 Jaipur District Jaipur and against the order dated 15.2.2010 passed by Judicial Magistrate No. 2 Jaipur District Jaipur in Criminal case No. 28 of 2009 wherein the application filed by the petitioners for compounding the offence under Section 498 A IPC dismissed on the ground that it is not compoundable. 3. Respective advocates with their clients are present today and by this petition they urged that their application for compromise may be accepted. 4. In these circumstances in the interest of justice I allow this misc. petition submitted by the petitioners and quash the order dated 15.2.2010 passed by the Judicial Magistrate No. 2 Jaipur District Jaipur and the criminal proceedings pending in the criminal case No. 28/2009 are quashed, since both the parties have settled their dispute and they are not interested any further in proceeding in the matter in view of the compromise filed by them before the trial Court on 15.2.2010. 5. Ordered accordingly. The Criminal Case No. 28/2009 State vs. Prithvi Singh and Anr. before the Judicial Magistrate No. 2 Jaipur District Jaipur may be treated to be closed.
