JUDGMENT 1. - This writ petition is directed against order dated 22.4.2009 passed by the Family Court, Udaipur in Case No. 296/2008 whereby in application preferred by the petitioner under Section 13 of the Family Court Act, 1984 (in short "the Act") seeking permission to be represented through a counsel, stands rejected. 2. In Sarla Sharma v. State of Rajasthan, AIR 2002 (Raj.) 301 , a Bench of this Court has taken the view that under Rule 22 of the Rajasthan Family Court Rules, 1994 (in short "the Rules"), the Family Court in its discretion may allow a party to engage lawyer or an advocate in a suit or proceedings pending before Family Court, in exceptional circumstances if it feels that engagement of a lawyer or advocate is necessary in the interest of justice. However, in yet another decision in the matter of Smt. Laxmi Kanwar v. Laxman Singh, 2004(2) DNJ (Raj.) 665 while considering the provisions of Section 13 of the Act and Rule 22 of the Rules, a Bench of this Court inter alia observed that the leave to be represented through a lawyer should normally be granted more particularly in a case where the parties are to travel from outside the place of sitting of Court. It was further observed that in such an event it is desirable that both the parties are allowed to be represented through lawyers. 3. In all fairness, the learned counsel for the parties submit that on the facts and in the circumstances of the case, in the interest of justice both the parties may be permitted to be represented through a lawyer. 4. Thus, having regard to the facts and circumstances of the present case, the decisions of this Court referred supra and the agreement arrived at between the parties, this writ petition deserves to be allowed. 5. Accordingly, the writ petition is allowed. The order impugned dated 22.4.2009 passed by the Family Court, Udaipur is set aside. The parties are permitted to be represented through their counsels before the Family Court, Udaipur in Case No. 296/2008. No order as to costs.Petition allowed. *******
