JUDGMENT Dev Darshan Sud, J.(Oral)-The State challenged the order of the Administrative Tribunal granting work charged status to the respondent herein on and w.e.f. 1.1.2002 when he completed ten years of continuous service as a Beldar. In its judgment the Tribunal holds:- “There is no dispute, but is clearly evident in view of the contents of Annexure R-3 that the applicant has completed 10 years continuous daily waged service as Beldar with minimum 240 days in each Calendar year by 31st of December, 2001.” 2. This finding of fact is based on the pleadings of the State and on the admission made by it before the Tribunal. This finding of fact cannot be upset in this petition as we find no material on the record to show that this admission was not made. 3. We find that this direction has been issued inconsonance with the direction issued by the Hon’ble Apex Court in Mool Raj Upadhyay vs. the State of Himachal Pradesh and Ors 1994(2) SLR 377 which have been reaffirmed in State of H.P. & ors. vs. Gehar Singh (Civil Appeal No. 1037 of 2007, decided on February 27, 2007. It is also undisputed that these directions are being implemented by the State uniformly for all its employees. 4. We do not find any merit in the petition, which is accordingly dismissed. There shall be no order as to costs. All interim orders are vacated. All miscellaneous applications are disposed of.
