Judgment :- The Learned Counsel for the Appellant/First Defendant has made an endorsement that the First Appeal has become infructuous and hence may be permitted to withdraw the same. In view of the said endorsement made by the Learned Counsel for the Appellant/First Defendant, the Appeal is dismissed as an infructuous one. No costs.
