Judgment :- 1. According to the Learned Counsel for the Appellant/ Defendant, the Appellant has intimated that he has settled the dispute with the Respondent/Plaintiff and hence, this Court may be pleased to dismiss the Appeal as withdrawn. Also to that effect, the Learned Counsel for the Appellant/ Defendant has made an endorsement. 2. In view of the endorsement and in view of the submission made by the Learned Counsel for the Appellant/ Defendant that the Appellant/ Defendant has settled the matter with the Respondent/ Plaintiff, this Court dismisses the Appeal A.S.No.929 of 2005 as withdrawn. No costs. Consequently, the connected miscellaneous petition is closed.
