Judgment :- 1. The 1st Respondent / 1st Defendant is reported to have expired. 2. The Learned Counsel for the Appellants/Plaintiffs 2 to 4 informs this Court that the Learned Counsel for Appellants has addressed a RPAD letter dated 26.02.2010 to the 1st Appellant/ 2nd Plaintiffs wife but the said letter has been acknowledged. But as on date they have not received any further intimation / instructions. As seen from the said letter, the 1st Appellant/ 2nd Plaintiffs wife has been directed to get in touch with the Learned Counsel for the Appellants immediately with details of the death of the 1st Respondent and to furnish a list of his Legal Representatives etc., for filing necessary petitions. 3. Inspite of the fact that the Learned Counsel for the Appellants has addressed a Registered Letter dated 26.02.2010 to the 1st Appellant/ 2nd Plaintiffs wife and the same being acknowledged, till date no steps have been taken to file necessary petitions in accordance with law before this Court. 4. In the circumstance, this Court is left with no option but to dismiss the Appeal for want of taking necessary steps , on the part of the Appellants. No costs.
