JUDGMENT 1. - The learned counsel for the petitioner has contended that according to the statement of Kajal, her father, the petitioner had merely rebuked the mother, the deceased, in this case. Moreover, a bare perusal of the prosecution evidence shows that there were certain disputes that had arisen between the husband and the wife. But, such disputes are quite common in a marriage. Therefore, there is nothing to suggest that the petitioner had acted in such a cruel manner as to abet suicide. Hence, offence under Section 306 is not made out. 2. The learned Public Prosecutor has contended that according to family members of the deceased, she was subjected to physical and mental cruelty which had forced her to commit suicide. 3. Without expressing any opinion on the merits and demerits of the case, but looking to the totality of the facts and circumstances of the case, this Court is inclined to grant the bail application of the petitioner under Section 439 Cr.P.C. 4. It is, therefore, ordered that the petitioner, Pramod Kumar Sharma S/o. Shri Ram Chandra Sharma, shall be released on bail provided he furnishes a personal bond in the sum of Rs. 30,000/- (Rs. Thirty Thousand) with two sureties of the same amount to-the satisfaction of the learned trial Court for his appearance before the trial court as and when he is called upon to do so.Bail Application Allowed. *******
