ORDER 1. The petitioners before this Court are teachers working in the Education Department have filed this present writ petition claiming the benefit of regular pay scale from the date of initial date of appointment. The contention of the petitioners is that other identically placed persons have been granted the benefit by this Court in the case of Damodar Prasad Sharma and others v. State of M.P and others in WP No. 2961/2006 (S) vide judgment dated 5th July, 2006. 2. Learned counsel for the petitioners as well as the learned counsel appeared for the State have informed this Court that in another identical matter i.e. WP No. 784/2009 (S) has been allowed by this Court directing the State Government to pass appropriate orders, in view of the order dated 11.11.2008 by which a decision has been taken to grant the benefit of regular pay scale subject to final outcome of the petition filed by the State Government before the Hon'ble Supreme Court. 3. Keeping in view the aforesaid, as the State Government has already issued an order dated 11.11.2008 to extend the benefit of regular pay scale to all identically placed employees subject to final order passed by the Hon'ble Supreme Court, the present writ petition is allowed with a direction to the respondents to pass appropriate orders keeping in view the order dated 11.11.2008 passed by the State Government by which the benefit of regular pay scale has been granted to identically placed employees subject to final outcome of the petition filed by/ the State Government before the apex Court. The aforesaid exercise shall be concluded within a period of three months from the date of receipt of certified copy of this order. 4. With the aforesaid observation the present writ petition stands disposed of. No order as to costs.
