Judgment : M. VENUGOPAL, J. 1. The Learned Counsel for the Petitioner/Appellant has made the endorsement in the Miscellaneous Petition which runs as follows: "The matter is settled between the parties. Hence there is no need to condone the delay in representation. The petition may be dismissed and the appeal may be rejected and the Court fees paid in the Memo of Appeal may be refunded U/Sec. 66 of Tamil Nadu Court Fees and Suit Valuation act, 1955." 2. In view of the endorsement that the matter is settled between the parties and hence, there is no need to condone the delay in representation, the Miscellaneous Petition praying to condone the delay in representation is dismissed. 3. In view of the fact that M.P.No.1 of 2010 praying to condone the delay in representation is dismissed by this Court, the Appeal filed by the Petitioner/Appellant is rejected. Resultantly, the Office of the Registry is directed to refund the Court Fee paid on the Memorandum of Appeal less commission, as per Section 66 of the Tamil Nadu Court Fees and Suit Valuation Act, 1955 and the Rules.
