JUDGMENT : 1. Petitioners are assailing the impugned orders passed by the Assistant Commissioner and the Karnataka Appellate Tribunal at Annexures-Q and R respectively in resuming the lands belonging to them to the Government alleging violation of Sections 79-A and 79-B of the Karnataka Land Reforms Act, 1961. 2. Heard. 3. According to the petitioners, they hail from agricultural family; petitioners and their ancestors are owning agricultural property at Khatoni Village of Ajmer District, Rajasthan and the translated copy of the RTC which was in Hindi was also produced to the 2nd respondent and as such, there is no violation of Sections 79-A and 79-B of the Karnataka Land Reforms Act and the purchase made by them is in order. 4. Having regard to the submissions made, it is for the 2nd respondent-Assistant Commissioner to verify the authenticity of the documents produced by the petitioners by securing the report from the concerned District Collector or the revenue authorities and on such verification, to pass appropriate orders in accordance with law. 5. Accordingly, petition is allowed and the impugned orders are quashed. The matter is remitted back to the Assistant Commissioner for disposal of the same in accordance with law.
