Judgment :- The writ Petition has been filed by the petitioner seeking a writ of mandamus, directing the respondent No.1 to release the 430 bags of rice seized from the Lorry bearing Registration No.AP-03-U-6379 by the respondent No.2 on 05.06.2008 to the petitioner on furnishing immovable property security. 2. When the matter is taken up for hearing today, the learned Additional Government Pleader produced a letter dated 10.12.2010 sent by respondent No.1 to the learned Government Pleader stating that an interim order was passed as per Section 6-A(2) of the Essential Commodities Act and as per which the entire rice was disposed under Public Distribution Scheme and the value was remitted in the Government account. It has been further stated that a show cause notice was issued under Section 6-B of the Essential Commodities Act and the enquiry is still pending. 3. In view of the above facts, the relief sought for in the writ petition no longer survives for consideration. Accordingly, the Writ Petition is dismissed. However, the liberty is given to the petitioner to raise all his contentions before the Deputy Commissioner (City) North in the proceedings under Section 6-B of the Essential Commodities Act. No costs.
