Judgment :- 1. This Writ Petition has been filed, challenging the notice issued by the second respondent, dated 10.12.2010, under Section 7 of the Tamil Nadu land encroachment Act, 1905. A notice had been issued by the second respondent, pursuant to the order, passed by this Court, on 02.11.2010, in W.P.No.23908 of 2007. 2. The main contention of the learned counsel for the petitioner is that he has not been given an opportunity of hearing to raise the objections, as permitted by this Court, by its order, dated 02.11.2010. 3. In such circumstances, this Court finds it appropriate to permit the petitioner to raise his objections before the second respondent, within 15 days from today. On such objections being raised by the petitioner, the second respondent shall pass appropriate orders thereon, on merits and in accordance with law, on considering the objections raised by the petitioner, within a period of fifteen days thereafter. This Writ Petition is ordered accordingly. No costs. Consequently, connected Miscallenous Petition is closed.
