ORDER Since the petitioners in all these petitions are one and the same, a common order is being passed. 2. Petitioners in all these petitions are seeking anticipatory bail in different crime numbers registered by the Vinobhanagar Police Station, Shimoga, for the offences punishable under Sections 406 and 420 of the Indian Penal Code, 1860 read with Karnataka Agricultural Produce Marketing (Regulation and Development) Act, 1966. 3. It is the case of the prosecution that the complainant is the Secretary of the APMC Yard, Shimoga and the accused-petitioners are the partners of M/s. Sri Mahalaxmi Areca Nut Company. The complaint allegations disclose that one Sri KM. Sathyamurthy, Areca Nut grower has supplied areca nuts to the petitioners' Finn for sale, but the petitioners have sold the same without giving any information to him or to the APMC and they have misappropriated the amount of sale proceeds. Therefore, the petitioners have committed the above said alleged offences. 4. Heard the learned Counsel for the petitioners and the learned High Court Government Pleader and perused the materials on record. 5. Sri Ravi B. Naik, learned Senior Counsel submits that Sections 118 and 118-A of K.A.P.M. Act are not penal in nature, but they are procedural in nature. 6. Therefore, having regard to the facts and circumstances of the case and also the fact that all the petitioners are aged more than 60 years, I am of the opinion that they are admitted for the benefit of anticipatory bail. 7. Hence, I pass the following: Order in Cri. P. No. 1991 of 2010 Petition is allowed and anticipatory bail is granted to the petitioners, subject to the following conditions: (i) If the petitioners are arrested in FIR No. 54 of 2010 (PCR No. 62 of 2010) of Vinobhanagar Police Station, Shimoga, they shall be released on bail on each of them executing a personal bond for a sum of Rs. 10,000/- with one surety for the likesum; (ii) They are directed to be detained in police station for a period not later than 10 hours on one day; (iii) The police are at liberty to file an application before the jurisdictional Magistrate seeking for further custody if necessary and the Magistrate shall pass necessary orders in accordance with law; (iv) Petitioners shall appear before the Court as and when summoned. Order in Cri.
Order in Cri. P. No. 1992 of 2010 Petition is allowed and anticipatory bail is granted to the petitioners, subject to the following conditions: (i) If the petitioners are arrested in PCR No. 68 of 2010 of Vinobhanagar Police Station, Shimoga, they shall be released on bail on each of them executing a personal bond for a sum of Rs. 10,000/- with one surety for the likesum; (ii) They are directed to be detained in police station for a period not later than 10 hours on one day; (iii) The police are at liberty to file an application before the jurisdictional Magistrate seeking for further custody if necessary and the Magistrate shall pass necessary orders in accordance with law; (iv) Petitioners shall appear before the Court as and when summoned. Order in Cri. P. No. 1994 of 2010. Petition is allowed and anticipatory bail is granted to the petitioners, subject to the following conditions: (i) If the petitioners are arrested in FIR No. 48 of 2010 (PCR No. 56 of 2010) of Vinobhanagar Police Station, Shimoga, they shall be released on bail on each of them executing a personal bond for a sum of Rs. 10,000/- with one surety for the likes urn; (ii) They are directed to be detained in Police Station for a period not later than 10 hours on one day; (iii) The police are at liberty to file an application before the jurisdictional Magistrate seeking for further custody if necessary and the Magistrate shall pass necessary orders in accordance with law; (iv) Petitioners shall appear before the Court as and when summoned. Order in Cri. P. No. 1995 of 2010 Petition is allowed and anticipatory bail is granted to the petitioners, subject to the following conditions: (i) If the petitioners are arrested in FIR No. 50 of 2010 (PCR No. 58 of 2010) of Vinobhanagar Police Station, Shimoga, they shall be released on bail on each of them executing a personal bond for a sum of Rs.
10,000/- with one surety for the likes urn; (ii) They are directed to be detained in police station for a period not later than 10 hours on one day; (iii) The police are at liberty to file an application before the jurisdictional Magistrate seeking for further custody if necessary and the Magistrate shall pass necessary orders in accordance with law; (iv) Petitioners shall appear before the Court as and when summoned. Order in Cri. P. No. 2004 of 2010 Petition is allowed and anticipatory bail is granted to the petitioners, subject to the following conditions: (i) If the petitioners are arrested in FIR No. 53 of 2010 (PCR No. 61 of 2010) of Vinobhanagar Police Station, Shimoga, they shall be released on bail on each of them executing a personal bond for a sum of Rs. 10,000/- with one surety for the likes urn; (ii) They are directed to be detained in Police Station for a period not later than 10 hours on one day; (iii) The police are at liberty to file an application before the jurisdictional Magistrate seeking for further custody if necessary and the Magistrate shall pass necessary orders in accordance with law; (iv) Petitioners shall appear before the Court as and when summoned. Order in Cri. P. No. 2006 of 2010 Petition is allowed and anticipatory bail is granted to the petitioners, subject to the following conditions: (i) If the petitioners are arrested in PCR No. 63 of 2010 of Vinobhanagar Police Station, Shimoga, they shall be released on bail on each of them executing a personal bond for a sum of Rs. 10,000/- with one surety for the likesum; (ii) They are directed to be detained in police station for a period not later than 10 hours on one day; (iii) The police are at liberty to file an application before the jurisdictional Magistrate seeking for further custody if necessary and the Magistrate shall pass necessary orders in accordance with law; (iv) Petitioners shall appear before the Court as and when summoned. Order in Cri. P. No. 1993 of 2010 Petition is allowed and anticipatory bail is granted to the petitioners, subject to the following conditions: (i) If the petitioners are arrested in PCR No. 64 of 2010 of Vinobhanagar Police Station, Shimoga, they shall be released on bail on each of them executing a personal bond for a sum of Rs.
Order in Cri. P. No. 1993 of 2010 Petition is allowed and anticipatory bail is granted to the petitioners, subject to the following conditions: (i) If the petitioners are arrested in PCR No. 64 of 2010 of Vinobhanagar Police Station, Shimoga, they shall be released on bail on each of them executing a personal bond for a sum of Rs. 10,000/- with one surety for the likesum; (ii) They are directed to be detained in police station for a period not later than 10 hours on one day; (iii) The police are at liberty to file an application before the jurisdictional Magistrate seeking for further custody if necessary and the Magistrate shall pass necessary orders in accordance with law; (iv) Petitioners shall appear before the Court as and when summoned. Order in Cri. P. No. 2003 of 2010 Petition is allowed and anticipatory bail is granted to the petitioners, subject to the following conditions.- (i) If the petitioners are arrested in PCR No. 69 of 2010 of Vinobhanagar Police Station, Shimoga, they shall be released on bail on each of them executing a personal bond for a sum of Rs. 10,000/- with one surety for the likesum; (ii) They are directed to be detained in police station for a period not later than 10 hours on one day; (iii) The police are at liberty to file an application before the jurisdictional Magistrate seeking for further custody if necessary and the Magistrate shall pass necessary orders in accordance with law; (iv) Petitioners shall appear before the Court as and when summoned. Order in Cri. P. No. 2005 of 2010 Petition is allowed and anticipatory bail is granted to the petitioners, subject to the following conditions: (i) If the petitioners are arrested in PCR No. 66 of 2010 of Vinobhanagar Police Station, Shimoga, they shall be released on bail on each of them executing a personal bond for a sum of Rs. 10,000/- with one surety for the likesum; (ii) They are directed to be detained in police station for a period not later than 10 hours on one day; (iii) The police are at liberty to file an application before the jurisdictional Magistrate seeking for further custody if necessary and the Magistrate shall pass necessary orders in accordance with law; (iv) Petitioners shall appear before the Court as and when summoned. Order in Cri.
Order in Cri. P. No. 2007 of 2010 Petition is allowed and anticipatory bail is granted to the petitioners, subject to the following conditions: Ii) If the petitioners are arrested in FIR No. 49 of 2010 (PCR No. 57 of 2010) of Vinobhanagar Police Station, Shimoga, they shall be released on bail on each of them executing a personal bond for a sum of Rs. 10,000/- with one surety for the likesum; (ii) They are directed to be detained in police station for a period not later than 10 hours on one day; (iii) The police are at liberty to file an application before the jurisdictional Magistrate seeking for further custody if necessary and the Magistrate shall pass necessary orders in accordance with law; (iv) Petitioners shall appear before the Court as and when summoned. Order in Cri. P. No. 2008 of 2010 Petition is allowed and anticipatory bail is granted to the petitioners, subject to the following conditions.- (i) If the petitioners are arrested in FIR No. 51 of 2010 (PCR No. 59 of 2010) of Vinobhanagar Police Station, Shimoga, they shall be released on bail on each of them executing a personal bond for a sum of Rs. 10,000/- with one surety for the likesum; (ii) They are directed to be detained in police station for a period not later than 10 hours on one day; (iii) The police are at liberty to file an application before the jurisdictional Magistrate seeking for further custody if necessary and the Magistrate shall pass necessary orders in accordance with law; (iv) Petitioners shall appear before the Court as and when summoned.
