ORDER : 1. The Criminal Petition No. 6741 of 2010 under Section 438 of the Cr.P.C. is filed seeking anticipatory bail to the petitioners in the event of their arrest. 2. Heard the leaned Counsel for the petitioner and the learned Public Prosecutor appearing for the State. 3. When the said petition came up for hearing on 20.07.2010, the learned Public Prosecutor submitted that no case is registered against the petitioners. Recording the same, the said Criminal Petition was dismissed by order dated 20.7.2010. 4. Today, the learned Counsel for the petitioners moved Crl. M.P. No. 6790 of 2010 in Crl. Pet. No. 6741 of 2010 under the caption ‘for being mentioned’ stating that a case in crime No. 27 of 2010 was registered against the petitioners on the file of the Women Police Station, Nellore and the petitioners are in the policy custody. The learned Public Prosecutor fairly submitted that whether the petitioners are arrested or in the police custody is not known. 5. The offence alleged against petitioners is under Sections 3 and 4 of the D.P. Act. In the circumstances aforestated, this Court is inclined to grant to anticipatory bail. 6. In the event of their arrest or if they are in the custody of police, respondents shall enlarge the petitioners on bail on their executing personal bonds of Rs. 10,000/- each with two sureties each to the like sum to the satisfaction of the Station House Officer, Women Police Station, Nellore Petitions are accordingly ordered.
