JUDGEMENT Rakesh Kumar and j. JJ. 1. When the case was called out, it was intimated by Shri Rajnikant Mishra, learned counsel appearing on behalf of the petitioner that he has learnt that petitioner has already died. However, he is not confirmed regarding the death of petitioner. 2. The petitioner, while invoking inherent jurisdiction of this Court under Sec.482 of the Code of Criminal Procedure, has prayed for quashing of order dated 18.8.1998 passed by the Chief Judicial Magistrate, Khagaria in Case No.219c of 1997. By the said order, learned Magistrate has taken cognizance of offences under Sections 452, 380, 379 and 323 of the Indian Penal Code. 3. I have perused the impugned order as well as materials available on record. I do not find any error in the order of cognizance. 4. Accordingly, the petition stands rejected. 5. Let a copy of this order be communicated to the court below forthwith.
