ORDER Amreshwar Pratap Sahi, J.—The claim is for payment of promotional pay scale. 2. The contention raised is that the censure entry which has been awarded to the petitioner stood wiped out in view of the law referred to in the order passed by the Director General of Police dated 31.3.2006. 3. Learned counsel for the petitioner contends that the denial of promotional pay scale to the petitioner is unjustified on the ground that the judgment of the learned single Judge which has been made the basis of the order dated 31.3.2006 grants the benefit automatically. The said judgment was upset on a reference made by this Court in a Division Bench judgment in Bhoopendra Singh and others v. State of U. P. and others, 2007 (4) ESC 2360 : 2008 (5) AWC 4282. 4. In view of this the aforesaid position the argument advanced on behalf of the petitioner cannot be accepted. 5. The writ petition is misconceived and is dismissed.
