Order Heard. 2. This writ petition has been filed against the order dated 22.7.2009, passed by learned Munsif, Bermo at Tenughat, in Title Suit No. 51 of 2000, dismissing the petition dated 6.5.2009 filed on behalf of the petitioners to recall the order dated 16.4.2009, by which the evidence of defendant was closed. 3. It is submitted that after the petitioners were substituted in 2008 they were given time twice to adduce evidence but the evidence could not be adduced and therefore the opportunity to adduce evidence was closed. 4. Counsel for the respondent pointed out that the predecessor of the petitioner also delayed the disposal of the suit and the evidence was closed at his time also but thereafter he was allowed to adduce evidence. 5. On this, counsel for the petitioners submitted that petitioners are ready to compensate other side by cost and in the interest of justice the prayer of the petitioners may be allowed by way of only one opportunity. 6. It is submitted by Mr. Banerjee, learned counsel for the petitioners that only one or two witnesses are to be examined. 7. In the circumstances, petitioners are directed to conclude their evidence within three weeks from today. Respondent will cooperate. If the petitioners fail to avail this last opportunity, their evidence will be closed. However, this order is subject to payment of cost of Rs. 5,000/- (Five thousand only) to other side in the court below within two weeks from today.
