ORDER : 1. Delay condoned. Issue notice of the special leave petition as also on the petitioners prayer for interim relief. Returnable in ten weeks. 2. In the meanwhile, Respondents 1, 2, 3, 6, 7 and 8 are directed to ensure that no mining activity is undertaken or continued at the site in question i.e. Jambunatheswara Temple situated in Village Jambhunatha, District Bellary, Karnataka. The respondents are directed to faithfully comply with this order. 3. The petitioner should serve xerox copies of this order upon the authorities concerned within the next seven days: “Court Masters Compliance Order of MoEF Subject: Aarpee Iron Ore Mine at Village Jambhunatha, Hospet Taluka, District Bellary, Karnataka of M/s Smt R. Mallamma Suspension of mining activities regarding. 1. Whereas the Ministry of Environment and Forests had granted environmental clearances to Aarpee Iron Ore Mine of Smt R. Mallamma (ML Area 101.51 ha) at Village Jambhunatha, District Bellary, Karnataka vide Letter No. J-11015/330/2005-IA II (M) dated 2-3-2006 and Letter No. J-1 1015/629/2007-IA II (M) dated 16-1-2008 for production of 0.65 million TPA and 1.5 million TPA of iron ore respectively. 2. Whereas Shri K. Guruprasad Rao filed Special Leave to Appeal (Civil) No. 20180 of 2010 before the Hon'ble Supreme Court of India challenging the order of the Hon'ble High Court of Karnataka at Bangalore in W.P. No. 9512 of 2009 (GM-MM-S) dated 6-8-2009, the Ministry of Environment and Forests is Respondent 7 in this appeal. 3. Whereas the Hon'ble Court, while hearing the matter, vide order dated 9-7-2010, K. Guruprasad Rao vs. State of Karnataka, (2012) 12 SCC 722 (2), has directed that: “In the meanwhile, Respondents 1, 2, 3, 6, 7 and 8 are directed to ensure that no mining activity is undertaken or continued at the site in question. The respondents are directed to faithfully comply with this order.” 4. Therefore in compliance with the above referred Hon'ble Supreme Court order dated 9-7-2010 in SLP (Civil) No. 20180 of 2010, Respondent 7, the Ministry of Environment and Forests hereby directs the project proponent Smt R. Mallamma of Aarpee Iron Ore Mine (ML area: 101.51 ha, Production capacity: 1.5 million TPA) at Village Jambhunatha, Taluka Hospet, District Bellary in Karnataka to stop all the mining activities in the said mine lease area forthwith. 5.
