JUDGMENT Kuldip Singh, J.(Oral)-This is an application under Section 439 Cr.P.C. for releasing the petitioner on bail in FIR No. 245/09 dated 19.7.2009 registered at Police Station, Nurpur, Distt Kangra under Sections 498, 306, 34 IPC. The status report has been filed. 2. It has been submitted by learned counsel for the petitioner that statement recorded under Section 154 Cr.P.C. of the deceased in no way implicates the petitioner for the commission of offence. He has submitted at the most that statement indicates that the petitioner had been ill-treating the deceased. He has submitted the petitioner is in jail since 19.7.2009 and in these circumstances the petitioner be released on bail. 3. The learned Addl. Advocate General has opposed the bail application and he has submitted that this Court has earlier rejected the bail applications of the petitioner on 4.9.2009 and 2.12.2009. He has submitted that the contention raised by the learned counsel for the petitioner has already been considered by this Court when the bail applications were earlier rejected. He has submitted that no new ground for granting of bail has been put forward by the petitioner. 4. The learned Addl. Advocate General has submitted that charge has already been framed against the accused on 27.3.2010 and now the case is fixed for prosecution evidence on 14.6.2010 to 16.6.2010. 5. I have gone through the record. The order dated 4.9.2009 has been placed on record. The statement of deceased under Section 154 Cr.P.C. has been noticed in that order and thereafter the bail application of the petitioner was rejected. The petitioner has not made out any case for the grant of bail on changed circumstances. Accordingly, bail application is dismissed. 6. The observations made in this order are for disposal of the bail application only and the same shall not be construed as express of opinion on the merits of the case.
