ORDER : 1. On 15.5.1988, this Court directed setting up of a hospital for treatment of the Bhopal Gas Victims. Accordingly, on 11.8.1988, Bhopal Memorial Hospital Trust (“BMHT” for short) was registered. Justice A.M. Ahmadi, former Chief Justice of India, was appointed as the Chairperson of BMHT. 2. According to the order of this Court dated 3.10.1991, Union Carbide Corporation vs. Union of India, (1991) 4 SCC 584 , BMHT was to run a hospital for eight years which period was extended subsequently. 3. By letter dated 22.6.2010 (marked “Confidential”) Justice A.M. Ahmadi, former Chief Justice of India, has requested this Court to accept his resignation from the post of Chairperson of the Trust. The resignation is duly accepted. 4. In the meantime, the learned Attorney General of India who is present in Court, on instructions, states that the Union of India has decided to take over Bhopal Memorial Hospital and Research Centre and run it through the Department of Biotechnology and Department of Atomic Energy. Accordingly, I.A. Nos. 58-59 of 2009 are made absolute in terms of Prayer Clause (ii), which reads as under: “Direct that the Central Government shall take over the hospital after winding up of the Trust.” Consequently, the Central Government will take appropriate steps pursuant to the Trust being wound up with immediate effect. 5. We hereby record our appreciation for the valuable services rendered by Justice A.M. Ahmadi, former Chief Justice of India, as the Chairperson of the Trust for the last twelve years. 6. The interlocutory applications are, accordingly, disposed of.
