Judgment : The petition is filed under Section 438 of the Criminal Procedure Code, 1973 seeking anticipatory bail, apprehending arrest for the offence punishable under Sections 468, 471 and 420 of Indian Penal Code, 1860. 2. The facts relevant for the purpose of this revision is as under. The petitioner is a student studying in Bharath Polytechnic, Bangarpet. On 19-1-2009 while he was traveling in the KSRTC Bus, the conductor checked his bus pass and found that it was a fake document and it was in the name of some other student. In the circumstances, on enquiry with the petitioner it revealed that he purchased the same for an amount of Rs. 1,300.00 from one Vinod. It is under these circumstances, a complaint was filed and a case was registered in Crime No. 223 of 2009 against the petitioner and another, who is said to have sold the fake document to the petitioner. 3. The petitioner submits that he is innocent and has not committed any offence. He apprehends his arrest for the above said offence and submits that in case if he is arrested, his educational career will be ruined. He is ready and willing to abide by any conditions that may be imposed for grant of anticipatory bail. On these grounds, he has sought for grant of anticipatory bail. 4. The learned Government, Pleader orally opposed the petition. He submits that the petitioner has not made out any such grounds for grant of anticipatory bail and requests to reject the petition. 5. I have heard the learned Counsel for the petitioner and also the learned Government Pleader. 6. The perusal of the identity card produced reveal that the petitioner is a student studying in Bharath Polytechnic, Bangarpet and he is aged about 19 years at the time of filing the petitioner. Furthermore the allegation made in the complaint reveal that the petitioner has purchased the said fake bus pass from another person by paying an amount of Rs. 1,300.00. Taking into consideration the facts that the petitioner is a student and that the fake document was not prepared by him and he had purchased the same from accused 2 and in case if he is taken into custody, his educational career will be ruined, I think that the petitioner has made out an exceptional ground for grant of anticipatory bail.
In the circumstances, I proceed to pass the following. The petition is allowed. The petitioner is ordered to be released on bail on his executing a personal bond for a sum of Rs. 10,000.00 with one surety for the like sum to the satisfaction of the arresting authority in the event of his arrest with further following conditions: (i) The petitioner shall appear before the Bangarpet Police Station on Every Sunday in between 10.00 and 11.00 a.m. until further orders. (ii) He shall not cause any threat force, coercion or influence to the prosecution witnesses.
