Judgment :- This writ petition is filed to quash the order of compulsory retirement in Tha.Ko.No.10/ Tha.Pi.Va(1)/99 dated 13.11.1999 of the first respondent and consequently direct the first respondent to reinstate the petitioner into service with all consequential benefits. 2. Learned counsel for the petitioner fairly submits that as against the order of punishment imposed namely compulsory retirement from service, an appeal will be filed by the petitioner to the Commissioner of Police/Appellate Authority and seeks direction as above. 3. Heard Mr. S. Sivashanmugam, learned Government Advocate. 4. In view of the submission made by the learned counsel for the petitioner, the petitioner is permitted to file an appeal on or before 31.03.2010. The Commissioner of Police/Appellate Authority is directed to consider and dispose of the same on merits within three months thereafter. As per the interim order of stay passed by the Tribunal, the petitioner will continues in service, till the disposal of the appeal. This writ petition is disposed of accordingly. No costs.
