JUDGMENT : Heard on the question of admission. Admit. LearnedPL takes notices of this admission and undertakes to produce the case diary atthe time of final hearing. Also heard on LA. No. 551/10, an application for grant of adinterim regular bail as he is in custody in connection of Crime No. 110/09,registered at Police Station, Bichhiya , District Mandla , for the offence under Sections 420, 468, 471, 477(B), 120-B of IPC and Section 3/7 of Essential Commodities Act. Asper submission of the applicant's Counsel, the applicant was posted as Choukidar in the alleged Fair Price Shop of Co-operativeSociety and he was not empowered to carry out or look after regular businessaffairs of the society. The same was looked after by Manager namely Amar Singh, co-accused of the instant case, who has beenextended the benefit of ad interim anticipatory bail, vide order dated 5-11-09in M.Cr.C . No. 11048/09, and where there is no suchallegation against the applicant. In spite that he is facing the judicialcustody since 23-12-09 andprayed for bail till the time the case diary is received and the petition isdecided finally. Havingheard, perused the impugned rejection order alongwith the papers available on record and the said order granting ad interimanticipatory bail to the co-accused, in the available circumstance, withoutexpressing any opinion on merits of the matter, subject to final decision, thisI. A. is allowed and the applicant is extended the benefit of interim regularbail. Itis further directed that on furnishing a personal bond of Rs .20,000/-( Rs . Twenty thousand) alongwith one surety of the like amount to the satisfaction of the Trial Court by the applicant, he shall be released on bail. Letthis matter be listed for final hearing in the week commencing 15-2-2010. C.c. as per rules.
