Judgment : 1. At this stage of the hearing of the Writ Petition, the learned counsel appearing on behalf of the respondents had submitted that, the Writ Petition has become infructuous, in view of the fact the Shop No.2 could not be confirmed in favour of the highest bidder, in the auction held on 21.01.2009, due to the pendency of the Writ Petition. Thereafter, a fresh auction had been notified to be held on 11.02.2010. 2. The learned counsel appearing on behalf of the petitioner had not refuted the submissions made by the learned counsel appearing behalf of the respondents. In such circumstances, the Writ Petition stands dismissed as infructuous. No costs. Consequently, connected Miscellenous Petition is closed.
