JUDGMENT : Pradeep Kumar, J. Heard learned Counsel for the petitioners, learned Counsel for the respondents and learned Counsel for the Ranchi University. 2. It is submitted by the learned Counsel for the petitioners that because of the dispute between the old management committee and the new management committee of Maulana Azad Colene, Ranchi, the salary of teaching and non-teaching staff, who are petitioners, from the period October, 2007 till October, 2010, has not been paid by the government, as the amount has not been released in favour of the College. 3. Having heard the learned Counsel for the parties, it appears that; (a) the present petitioners, who are teaching and non-teaching staff of Maulana Azad College, Ranchi, have worked for the period running from October, 2007 till date i.e. October, 2010. (b) That for this period, they are entitled to get their salary, which has to be released by the State in favour of Maulana Azad College, Ranchi having their account in Union Bank of India, Saheed Chowk Branch, Ranchi. (c) In view of the fact and keeping in mind the fact that since long teaching and non-teaching staff i.e. petitioners of the college are waiting for their salary and their salary has not been deposited till date by the Government in favour of Maulana Azad College, Ranchi, the State is directed to release the salary for the said period without any further delay in favour of Maulana Azad College in their Bank Account at Union Bank of India, Saheed chowk Branch, Ranchi. 4. As agreed by the State and Ranchi University, a committee of the following members is constituted for assisting in the distribution of the salary: (A) State: (1) Assistant Director, Higher Education, Department of HRD. (2) Deputy Director, Higher Education, Department of HRD. (B) Ranchi University: (3) Finance Officer, Ranchi University, Ranchi. (4) Any nominee of Vice Chancellor, Ranchi University. 5. The aforesaid four officers will decide the salary amount of each petitioners and that amount will be deposited in their respective bank accounts, after making necessary deductions like PPF, GPF etc. permissible under the law from the Bank account of the college. (B) Ranchi University: (3) Finance Officer, Ranchi University, Ranchi. (4) Any nominee of Vice Chancellor, Ranchi University. 5. The aforesaid four officers will decide the salary amount of each petitioners and that amount will be deposited in their respective bank accounts, after making necessary deductions like PPF, GPF etc. permissible under the law from the Bank account of the college. These petitioners are entitled to their salary from October, 2007 till October, 2010 and the aforesaid exercise will be completed, as early as possible, and preferably within two weeks from the date of receipt of amount from the State Government by the college and upon fixation of the amount towards arrears of each petitioners by the aforesaid committee, they will communicate the same to the respondent Nos. 4 and 5 and upon receipt of such fixed amount for each petitioners, the said amount will be deposited and transferred by the respondent Nos. 4 and 5 in the Bank accounts of the petitioners by completing necessary bank procedure. All the respondents shall co-operate in completing this bank procedure for transfer of amount of salary to the bank accounts of the petitioners. 6. The counsel for the petitioners shall inform all the respondents about their bank accounts and the petitioners shall cooperate in deciding the aforesaid amount/salary and in deductions etc. 7. The aforesaid arrangement is made tentatively in distribution of accumulated salary with Union Bank of India, Saheed Chowk Branch, Ranchi for the period running from October, 2007 to October, 2010. 8. It is also agreed by the learned Counsel for the petitioners and the learned Counsel for the Ranchi University that within a period of two months, Ranchi University will constitute an ad hoc Governing Body, who will start functioning and look into the affairs of the management in distribution of salary of teaching and non-teaching staff and then salary will be distributed by the same Governing Body. 9. With the aforesaid direction, this writ petition is disposed of. Petition disposed of.
