Judgment :- Original application No. 9120 of 1998 was filed before the Tamil Nadu Administrative Tribunal prayer to call for the records made in the impugned order in No.Na.Ka.No.87555/C4/98 dated 20.8.98 on the file of the respondent and direct the respondent include the names of the petitioner in the appropriate place as per seniority and to revise the Panel for promotion to the post of High School Headmaste. Since the Tamil Nadu Administrative Tribunal was abolished, the original application was re-transferred and numbered as writ petition. 2. The petitioners are B.T. Assistant with the Tamil Nadu Education Department. They are recruited through the Tamil Nadu Public Service Commission and were regularised with effect from date of appointment which was in the year 1970. While preparing the panel for promotion to the post of Headmaster of the High School, the period from the date of entry in the service was not taken into consideration and it is only the date of on which the seniority was fixed by Tamil Nadu Public Service Commission that was considered and therefore the petitioners have lost a considerable period of time in their service, which would have yielded to them certain benefits at the time of promotion. 3. The original application has been filed in the year 1998. By this time, the petitioners would have reached the age of superannuation. Therefore, it will suffice if liberty is given to the petitioner to make a representation to the Government or Directorate of School Education for redressal after grevence. Accordingly, petitioners are given liberty to make a representation to the Government or the Director of School Education to consider their claim for service benefits along with a copy of this order. If such a representation is made, it shall be considered and disposed of on merits by the respondents within a reasonable period of time preferably within three months from the date of receipt of such representation. The writ petition stands disposed of accordingly.
