Judgment : The Court: The petitioner in this art.226 petition dated July 25, 2011 is seeking the following principal relief: “(b) A Writ of and/or in the nature of Mandamus do issue commanding the respondents herein to grant amortization for the payment of the residual principal loan amount at the rate of monthly instalments of Rs.5,000/- per month and a further relief from payment of the changeable interest.” The petitioner took a commercial loan from Allahabad Bank. He issued a legal notice dated April 4, 2011 alleging that the bank violated the terms and conditions of the loan. By a notice dated May 5, 2011 the bank asked the petitioner to pay the amount mentioned therein stating that his failure would compel the bank to initiate proceedings under provisions of law including the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002. The petitioner had no right to call upon the bank to give him opportunity of paying the outstanding debt in instalments. I am, therefore, unable to see how he can approach the High Court under art.226 seeking a mandamus commanding the bank to allow him to amortize the debt at the rate of Rs.5,000 per month. In my opinion, the petition is misconceived. For these reasons, the petition is dismissed. No costs.
