Judgment :- 1. Writ Petition is filed praying to issue a Writ of Mandamus, directing the respondent to consider the application of the petitioner dated 10.2.2011 and consequently permit the petitioner to participate and purchase sandal wood in the tender-cum-auction sale to be conducted at Government Sandal wood Depot at Salem on 03.03.2011 and to deliver the sandalwood if any purchased to the petitioner on fulfillment of the terms and conditions of the sale notice conditions published in the District Gazette Salem No.1 dated 28.01.2011. 2. Mr.S.N.Kirubanandham, learned Special Government Pleader, takes notice on behalf of the respondent. By consent of both parties, the writ petition is taken up for final disposal. 3. Heard Mr.K.Venkataramani, learned Senior Counsel appearing for the petitioner and Mr.S.N.Kirubanandan, learned Special Government Pleader (Forests) appearing for the respondent. 4. The petitioner seeks indulgence of this Court for a direction to participate in the Tender - cum - Auction sale to be conducted by the respondent on 03.03.2011. The grievance of the petitioner is that the respondent authority has not issued the Tender Schedule in spite of the representation dated 10.02.2011. Hence the present writ petition. 5. Subject to the condition that the petitioner complies with the requirement for issuance of Tender Schedule by making appropriate payment, the Authority on production of a copy of this order and necessary payment shall issue the Tender Bulletin so as to enable the petitioner to participate in the Tender - cum - Auction sale to be held on 03.03.2011. It is made clear that if the petitioner does not comply with the requirement before the time Schedule, the respondent shall not be held responsible. 6. The Writ Petition is disposed of as above. No costs. Consequently, connected miscellaneous petition is closed.
