JUDGMENT Mr. S.S. Saron, J.:— Heard counsel for the parties. 2. The petitioner seeks regular bail in a case registered against her on 29.08.2010 for the offences under Section 306, 506 and 34 IPC at Police Station Tarn Taran. 3. The FIR in the case has been registered on the statement of Kanwaljit Kaur whose son Jiwanjot Singh committed suicide. 4. According to the complainant her husband Rajwant Singh had developed illicit relations with Pardeep Kaur (petitioner) and he used to ill-treat his son Jiwanjot Singh (deceased). Rajwant Singh had started staying permanently with Pardeep Kaur (petitioner). The complainant had been living with her father at Chhapa Ram Singh for the last five years. Rajwant Singh had given separate room to his sons Jiwanjot Singh alias Arsh (deceased) and Ranyodh Singh alias Jodha. Jiwanjot Singh alias Arsh had been informing his mother (complainant) that he was upset with the actions of his father and if he stopped him he used to beat him. Later on, Rajwant Singh at the instigation of Pardeep Kaur (petitioner) beat up both her children and turned them out of the house. However, he (Rajwant Singh) kept the younger son Ranyodh Singh alias Jodha with him. Jiwanjot had gone to the wife of his father’s elder brother at Bale Chak. At some times, Jiwanjot used to go Chheharta to see his younger brother-Ranyodh Singh. Some 12/13 days earlier, Jiwanjot Singh (deceased) called the petitioner on telephone and told her that he had gone to his aunt at Bale Chak where Rajwant Singh went and beat him very much. He said that he was very much upset and did not want to live and saying this, he disconnected the phone. On 28.08.2010, somebody made a phone call to the complainant that Jiwanjot Singh had consumed some poisonous substance. On 29.08.2010, the complainant along with her father Jaspal Singh and also Daljit Singh came to village Bale Chak and saw that Jiwanjot Singh was lying dead. Jiwanjot Singh being fed up with Rajwant Singh and Pardeep Kaur (petitioner), had consumed some poisonous substance and ended his life. 5. The petitioner is 55 years of age and a widow. She has a daughter and a son who are both students of class Xth and VIIIth respectively. It is submitted that the petitioner has no hand in the commission of suicide by Jiwanjot Singh. 6.

After giving my thoughtful consideration to the matter, it may be noticed that the petitioner is in custody since 03.09.2010. The Challan in the case has been filed. The prosecution is to establish and prove its case by leading evidence. It is to be established whether the petitioner had abbetted the commission of suicide. The petitioner is staying at village Chheharta whereas Jiwanjot Singh committed suicide at village Bale Chak, which is at a distance of 40 to 45 Kms from Chheharta. The complainant-Kanwaljit Kaur is residing at village Chhapa Ram Singh which is at a distance of 40 Kms. from village Bale Chak. 7. In the facts and circumstances, the petitioner on her furnishing personal bond and surety to the satisfaction of the learned Chief Judicial Magistrate, Amritsar shall be admitted to bail.
