ORDER 1. Latest status report dated 7.9.2011 has been filed on behalf of the State Government wherein it is stated that, as on date, 517 places of worship have been demolished. 2. On the last date of hearing, Shri Anshuman Singh, learned counsel appearing for the Corporation, had assured us that necessary action will be taken for the removal of Kali Mandir situated at George Town. Vide I.A.No. 8958/2011 filed , today, it is submitted on behalf of the Corporation that negotiations with the management committee of the temple are still going on to demarcate the. extent of encroachment and voluntarily remove the same in a cordial environment. The Authority representating the Corporation present today in the Court has assured us that before the next date of hearing positively, necessary action will be taken for the removal of Kali Mandir. The Authority has also assured that no encroachment, even temporary, will be permitted on the places from where Durga Mandir (Delite Talkies) and Sai Temple (South Civil Lines) have been removed and these places will be made encroachment free. 3. Shri H.C. Kohli, learned counsel appearing for Sai Temple, Gwarighat, Jabalpur, stated that the management committee of the temple will make every effort to make an alternative arrangement within two months for shitfing the temple. We hope that effective effort will be made by the management committee in this regard. 4. By order dated 11.2.2010 the District Authoritites were directed to remove the complete structure of Ganesh Temple situated at Khandari Ret Naka, Gwarighat. On 25.2.2011 the learned Government Advocate submitted that a part of the temple has already been demolished and in respect of the remaining part, notices were issued to the interested pmies but without any response from them. Today, Shri P.K. Kaurav, learned Deputy Advocate General for the State, assured us that the order dated 11.2.2010 will be positively complied with before the next date of hearing. 5. LA. No. 11061/2011 has been filed on behalf of Akashdeep Gupta for permission to intervene. A copy of the same has been supplied to Shri P.K. Kaurav and Shri Anshuman Singh who pray for time to file reply. 6. Prayer allowed. 7. Pursuant to our order dated 29.7.2011 Shri Awadh Shrotri, Chief Executive Officer, Jabalpur Development Authority, is present in person. No. 11061/2011 has been filed on behalf of Akashdeep Gupta for permission to intervene. A copy of the same has been supplied to Shri P.K. Kaurav and Shri Anshuman Singh who pray for time to file reply. 6. Prayer allowed. 7. Pursuant to our order dated 29.7.2011 Shri Awadh Shrotri, Chief Executive Officer, Jabalpur Development Authority, is present in person. The status report dated 6.9.2011 has also been filed by the Jabalpur Development Authority wherein it is stated that, as on date, four places of worship have been demolished and , now only five such unauthorized places of worship are left to be demolished. The Chief Executive Officer has assured us that before the next date of hearing, necessary action will be taken for the removal of these unauthorized places of worship also. He is granted time to do so. He will, however, remain present in person on the next date of hearing and shall also submit the status report. 8. Shri Sudhir Shrivastava, learned counsel for the Railways, prayed for sometime to file the status report with regard to removal of unauthorized places of worship. 9. Prayer allowed. 10. We direct that the District Authorities will extend full cooperation to the Railway Authorities in the removal of unauthorized places of worship. 11. The petitioner has filed IA No. 9405/2011, a copy of which has been supplied to Shri P.K. Kaurav and Shri Anshuman Singh. They pray for time to file reply. 12. Prayer allowed. 13. Having regard to the progress in the matter, we direct the District Authorities to do survey and submit a consolidated list with regard to unauthorized places of worship on or before the next date of hearing. 14. List the case for further orders on 11.11.2011.
