JUDGMENT N. KUMAR, J.—This appeal is filed by the wife challenging the decree of divorce granted by the Family Court dissolving their marriage on the ground of cruelty. 2. After filing of the petition for divorce, the wife has lodged a criminal prosecution under Section 498A of IPC and is pending in CC No. 10425/2009 on the file of V Additional Chief Metropolitan Magistrate, Bangalore. 3. In this background now both the parties have filed a compromise petition under Order 23, Rule 3 of CPC duly signed by the learned Counsel for the parties and their respective counsels. 4. The terms of the compromise is that the decree of divorce granted by the trial Court is to be affirmed subject to the condition that the husband has agreed to pay Rs. 1,500/- per month as permanent alimony towards the maintenance to the wife from the date of this decree. The wife has agreed to withdraw CC No. 10425/2009 initiated against the respondent and his family members. 5. Parties are present before the Court. They admit the execution, as the terms of the compromise are legal. We accept the compromise. In terms of the compromise this appeal is disposed of.
