ORDER 1. Petitioners seek following reliefs :- “I. The Hon'ble Court may kindly be pleased to issue a writ in the nature of Mandamus commanding the respondent No.4 to immediately conduct the examination of B.Com. Final Year/B.B.A. Final Year (6th Semester) and declare the results of the petitioners. II. The Hon'.ble Court may kindly be pleased to issue a writ in the nature of Mandamus commanding the respondent No.2 to conduct the counselling after the results of the petitioners, studying in the Final Year of B.Com./B.B.A. in the respondent No.4 University, has been declared. III. To grant any other relief which this Hon'ble Court deems fit and proper. " 2. On direction to seek instructions learned By. Advocate General who also represents respondent No.4 i.e. Rani Durgavti Vishwavidyalaya has to submit that vide Notification No. ijh{kk /2011/Sept. 11,2011, the B.Com. VIth Semester Examination has commenced. It is urged that the subjects for which examination could not be held on 19.9.2011, 21.9.2011, 26.9.2011 and 28.9.2011, fresh dates are being announced. In respect of rest of the subjects it is stated that the examinations are held as per the schedule. 3. Regarding the relief to conduct the counselling for M.B.A. after the result of the B. Com final year (i.e. VIth Semester), learned counsel for respondents submits that the petitioners since did not appear in the M.B.A. entrance examination held in the month of September, 2011 as they were not eligible, the counselling cannot be deferred. It is contended that the petitioners being not eligible will also be not benefited of the provisions contained in Clause 5. 4. Petitioners admittedly have not completed their graduation as would make them eligible to reap benefit of above provision. Moreover, the date of counselling as per schedule date 10.8.2011 has also expired. 6. In the result. as no relief can be granted to the petitioners. The petition fails and is hereby dismissed.
