JUDGMENT 1. - The petitioner, the respondent's minor son, has knocked at the doors of this Court for seeking justice. According to the petitioner, his father happens to be a lecturer at the Gokul Verma Rajkiya Polytechnic University. Vide order dated 22.4.2009, the Family Court, jodhpur, had directed the respondent to pay a maintenance of Rs. 1,800/- per month to the petitioner-son. However, the petitioner has pleaded that an extremely meager amount has been paid for his maintenance. Hence, his prayer. that the maintenance should be enhanced to a respectful sum. 2. Mr. M.K. Trivedi, the learned counsel for the petitioner, has vehemently contended that according to the salary certificate issued by the University, the respondent's gross income is Rs. 31,767/- per month, and, after, deduction, the take home salary is Rs. 26,295.82 per month. Therefore, the payment of merely Rs. 1,800/- per month is an extremely unreasonable amount. Moreover, the petitioner, who is a child, needs to be educated and needs to be looked after. Therefore, the maintenance amount should be enhanced by this Court. 3. On the other hand, Mr. Sanjay Mathur, the learned counsel for the respondent has strenuously contended that the petitioner's mother is herself employed as L.D.C. Hence, she has sufficient means for looking after the welfare of the child. Hence, the maintenance of Rs. 1,800/- per month is more than just and reasonable. 4. Heard the learned counsel for the parties and perused the impugned order as well as the salary certificate submitted before this Court. 5. It is, indeed, trite to state that it is the joint responsibility of the parents to look after the welfare of their child. Although, the learned counsel for the respondent has pleaded that the couple has separated due to the faults of the mother, but for the faults of the mother, the child cannot be made to suffer. Therefore, the respondent cannot absolve himself of his liability and responsibility to maintain the petitioner. 6. A bare perusal of the facts of the case reveal that while the mother is working as a LDC, the father happens to be a lecturer at the Gokul Verma Rajkiya Polytechnic University. Thus, obviously the child comes from a middle class family. Presently, the child is about eleven years old; he needs to be looked after for another seven years.

Undoubtedly, it cannot be the sole responsibility of the mother to bring up the child. In fact, it is both the moral and legal responsibility of the father to share the burden of bringing up the child. 7. According to the salary certificate issued by the Institution, the respondent has a take-home pay of Rs. 26,295/- per month. This factum has not been denied by the respondent. Considering the fact that the mother cannot be burdened with the sole responsibility of bringing up the child, considering the fact that the petitioner would need to be educated and would need to be well looked after, this Court enhances the maintenance amount from Rs. 1,800/- per month to Rs. 5,400/- per month. The said amount shall be payable from the date of the submission of the original application for maintenance before the Family Court, Jodhpur. The arrears of maintenance shall carry an interest of 6% per annum. The maintenance shall be paid by the respondent-father in three equal installments along with the interest.With these observations, the petition is, hereby, allowed.Petition allowed. *******
