JUDGMENT Kurian Joseph, J. The State has come up in appeal aggrieved by the judgment dated 6.5.2009 in CWP (T) No.7716 of 2008. The appeal is disposed of directing the Director to consider the case of the writ petitioners for promotion to the post of Junior Assistants notified on 5.3.1998 since the stand taken in the reply filed by the Director was that the Secretary, Nagar Panchayat was not competent to issue any order of promotion. The apprehension of the State at this stage is that the question as to the effect of integration of municipal service of the employees is also a matter, which should have been considered by the learned Single Judge. That was an issue before this Court in another writ petition, which has been disposed of directing the Government to take a final decision. Therefore, we do not think that any interference is warranted in this case since at the time of decision taken by the Director, as directed by the learned Single Judge, all these relevant aspects can be taken into consideration by the Director. By way of abundant caution, we make it clear that while implementing the direction issued by the learned Single Judge (if not already implemented), the writ petitioners shall also be afforded an opportunity of hearing. 2. With the above observations, the appeal is disposed of, so also the pending applications, if any.
