JUDGEMENT 1. Heard Mr. Swapnil Kumar for the appellants, and Mr, Prafull Chandra Jha for the respondent. The State of Bihar has preferred this appeal under Clause 10 of the Letters Patent of the High Court of Judicature at Patna, and is aggrieved by the order dated 18.5.2009, passed by a learned Single Judge of this Court in C.W.J.C. No. 6078 of 2009 (Hem Chandra Jha vs. The State of Bihar & Ors.), whereby the writ petition has been allowed, the order setting aside the appointment of the writ petitioner as non-medical assistant has been set aside, and the State of Bihar has been given liberty to proceed afresh against the petitioner in accordance with law, if they so desire, and also include within the ambit of enquiry those of the functionaries who were responsible for such allegedly illegal appointments. We agree with the order of the learned Single Judge. 2. The appeal is accordingly dismissed.
