JUDGEMENT R.M.Doshit, J. 1. Learned advocate Mr. Bindeshwar Sah has appeared before us. He has submitted that he has instructions to appear on behalf of the petitioner, an advocate practicing in this Court and that he shall file vakalatnama in the Registry in the course of the day. The petitioner has filed this petition under Article 226 of the Constitution to seek implementation of the Bihar (Cases Flow Management in High Court) Rules, 2008 notified in the Official Gazette of the Government of Bihar on 31st October 2008. It is the complaint of the petitioner that cases are not notified for hearing in accordance with the priority to be assigned to them under the aforesaid Rules of 2008 i.e. Fast Track, Normal Track and Slow Track. In support of his complaint the petitioner has not placed material facts on the record. In absence of the material facts no mandamus in the manner prayed for can be issued. For the aforesaid reason the petition is dismissed. The parties will bear their own cost.
