JUDGMENT V.K. Ahuja , J. The petitioner is aggrieved by his transfer as Operation Theatre Assistant from Kamla Nehru Hospital, Shimla, to I.G.M.C., Shimla. Both these institutions are under respondent No. 2, who has passed the order. The distance in between the two institutions is stated only 2 KMs as per the learned counsel for the petitioner during the course of arguments. The learned counsel for the petitioner submits that the petitioner has to look after his son, who is suffering from mental tarden and he may be allowed to continue in the present institution. His grievance has been looked into by respondent No. 2 in the representation submitted to it, who has rejected the representation for the administrative reasons. The transfer in question, therefore, cannot be said to be made not in public interest. It is for the Head of the Department to consider at which place, services of an employee should be better utilized. Keeping in view certain complaints, the impugned order was passed by respondent No. 2 as is clear from the order (Annexure P-6) itself. No case is made out for allowing the petition filed by the petitioner. The same is dismissed accordingly, so also the pending miscellaneous application(s), if any.
