JUDGMENT Rajiv Sharma, Judge Mr. Sandeep Sharma, learned Assistant solicitor General of India, on the basis of instructions imparted to him by the respondents submits that in sequel to judgment rendered by this Court in CWP No. 1057/2003 dated 24.4.2007, petitioner was brought before the Review Medical Board on 7.1.2008. His disability was assessed more than 20% and was paid disability pension from 2007 onward. However, the petitioner has claimed his disability with effect from 2.7.1984, the date he was boarded out from Indian Army. In fact, petitioner was required to be paid disability pension from the date of his discharge, i.e. 2.7.1984 since his disability to the extent of more than 20% will relate back to this period. However, Mr. Sandeep Sharma submits that the Government of India may not be burdened with interest. There is merit in the submission of Mr. Sandeep Sharma. 2. Accordingly, the petition is closed with the directions to the respondents to pay and release disability pension to the petitioner with effect from 2.7.1984. Arrears etc. be paid within a period of two months after the production of certified copy of this judgment by the petitioner. It is made clear that the petitioner shall not be paid any interest on the aforesaid amount. Notice is discharged.
