JUDGMENT 1. - By way of this criminal miscellaneous petition filed u/s 482 Cr.PC. the petitioners have prayed for quashment or FIR No. 196/2010 registered at Police Station Kardhani, Jaipur for offences u/s 447, 504 IPC and also section 3(1) (5) (10) of the SC & St (Prevention of Atrocities) Act stating that after lodging of FIR, the parties have entered into a compromise and that the non-petitioner No.5 complainant has already filed his affidavit before the Investigating Officer as also before the Deputy Commissioner Police, Jhotwara stating that the parties have no dispute with regard to Khasra No.390. 2. Despite the non-petitioner complainant's filing of application on 21.5.2011 seeking closure of the matter against the accused petitioner, Investigating officer, has not paid any heed thereto. 3. Heard the learned counsel for the petitioners as also the non petitioner no.5 (complainant) and the learned Public Prosecutor. 4. In para 3 of the petition it is mentioned that the dispute arose on account of confusion with regard to boundaries of two khasra numbers and because of the complainant land being situated adjacent to the land of the husband of petitioner No.2 and that said confusion arose which has already been sorted out. The complainant is not interested to pursue the complaint and the parties have entered into compromise. The dispute being purely personal in nature and not involving any matter of public policy, it appears just and proper to allow the prayer of the petitioners in the given circumstances and the criminal proceedings filed in the form of FIR no.196/2010, be quashed. 5. Accordingly, the petition of the petitioners u/s 482 Cr.PC. seeking quashment of FIR No. 196/2010, lodged in Police Station Kardhani is allowed and FIR in question is quashed in view of the compromise having been arrived at between the parties.The petition as well as stay application stand disposed.Petition Disposed of as Above. *******
