ORDER 1. This is a petition for review of the order dated 18.10.11 passed in MA No. 765/10 whereby claim petition filed by petitioners was allowed and the amount awarded is enhanced. 2. Learned counsel for the petitioner submits that the petitioner No.1 has filed a petition for custody of petitioner No.2 and the matter is pending in the Court of SDM under section 97 CrPC. It is submitted that the petitioner No.1 is facing problem in getting a favourable order from the SDM as it is pointed out that since this Court has decided that the custody of the petitioner No.2 is with respondent No. 5 & 6, therefore, it cannot be said that petitioner No.2 is in unlawful custody of the respondent No. 5 & 6. It is submitted that the petition filed by the petitioners be allowed and the order be reviewed. 3. From perusal of the record it is evident that this Court has only decided, the appeal against the award which relates to the amount of compensation for which petitioners are entitled. The order of this Court cannot be taken that this Court has decided relating lawful/unlawful custody of petitioner No.2 with respondent No. 5 & 6. This aspect of the case has to be decided by the competent Court as per law. 4. With the aforesaid observations, petition stands disposed of.
