ORDER 1. This is repeat application for grant of bail. The earlier one was dismissed on merits vide order dated 21.5.10 passed in MCrC No. 2812/l0. The corresponding trial is pending as ST No. 22/10 before Special Judge, Raisen. 2. After being arrested in connection with Crime No. 217/2009 registered at Police Station Sultanpur, District Raisen, in respect of the offence punishable under Section 34 (2) (1) of the M.P. Excise Act and Sections 420, 467 and 468 of the IPC, the applicant is in judicial custody. 3. Allegations against the applicant, in short, are that he was found involved in illegal transportation of 12000 litres of O.P. Spirit in a Tanker bearing registration No. HR-38K 5242 that too, on the basis of forged documents suggesting that the Tanker was being used for transportation of a chemical namely formaldehyde that was also found stored in the upper part. 4. Learned counsel for the applicant has submitted that the trial is still pending whereas the applicant has suffered imprisonment for more than a year, which is the minimum sentence prescribed for the offence under the Act. 5. Taking into consideration the period of incarceration already suffered by the applicant, but without expressing any opinion on the merits of the case, I am of the view that the applicant deserves to be enlarged on bail on comparatively stringent conditions. 6. The application is, therefore, allowed that it is directed that applicant Ramsingh shall be released on furnishing a personal bond in the sum of Rs. 40,000/- (Rupees forty thousand) with two solvent and local sureties of Rs.20,000/- (Rupees twenty thousand,) each to the satisfaction of the trial judge for his appearance during trial.
