JUDGMENT Kurian Joseph, J. The dispute pertains to the allotment of seven shops under the first respondent in respect of the local dealers/traders in Agricultural produce. One dispute pertains to the question as to the connotation of the word ‘local’. This Subzi Mandi is for Palampur. We are informed that there are Subzi Mandies for the neighbouring Tehsils like Baijnath, Kangra, Nurpur and Jawalamukhi. So necessarily the local can only mean at least the Tehsil of Palampur. Therefore, we make it clear that while making the allotment for local dealers/traders in Agricultural produce, the selection in respect of seven shops shall be limited to those dealers/traders in Agricultural produce in Palampur Tehsil, of course subject to the fulfillment of other eligibility conditions. 2. Another dispute is with regard to the mode of allotment. We are informed that certain shops have been allotted on the basis of public auction. Therefore, we make it clear that highest price in the bid shall be the basis for allotment for local dealers and traders in Palampur, while lots are drawn as per condition No. 4. It is made clear that in case there is any paucity of required number of persons in the respective quota, the Committee shall issue fresh notice and in case of fresh notice, eligibility will be decided on the basis of the date of the notice. Needful, as above, shall be done within a period of two weeks from today. 3. The writ petition is disposed of, so also the pending application(s), if any. 4. A copy of this judgment, duly authenticated by the Court Master, shall be supplied to the learned Advocate General, immediately.
