JUDGMENT Per Justice V.K. Ahuja, J. The petitioner is also one of the persons, who had applied for allotment of a shop. According to the notice inviting applications, the person applying for allotment has to be a person registered with the Marketing Committee, Kangra, but should be a licensee for running fruits and vegetables business at Palampur. The petitioner admittedly is not a person, who is running business in his name at Palampur, though he claims that he is running the business on behalf of his uncle Babu Ram, who was the original allottee and was registered as a trader. This was the condition provided in the notice inviting applications and the petitioner does not satisfy the requirement of the said notice and as such, is not eligible to apply in his name, though he could have applied in the name of original allottee, Babu Ram, for which the time has already elapsed. Moreover, he is also not the permanent resident of notified area of District Kangra. Therefore, the petitioner has no case and as such, the petition filed by him is dismissed. 2. The petition stands disposed of, so also the pending application(s), if any.
